Terms of service (offer agreement)

1. General provisions
1.1 This Agreement is an official offer (public offer) of the ReallyCool LLC service for language community (hereinafter referred to as the "Contractor") for a fully capable individual (hereinafter referred to as the "Customer") who accepts this offer on the terms and conditions specified below.
1.2 This agreement has the nature of a public offer agreement in accordance with Art. 633 of the Civil Code of Ukraine, is the equivalent of a bilateral agreement and, in accordance with the current legislation of Ukraine, has due legal force from the moment of full and unconditional acceptance by the user of the terms of this Agreement (Offer) and its Annexes. This Agreement is public, its terms are the same for all consumers.
1.3 The information below is an official offer (public offer) to any legal entity or individual to conclude a contract for consulting services for learning a foreign language. According to Art. 642 of the Civil Code of Ukraine, full and unconditional acceptance of the terms of a public contract is the fact that the Subscriber makes a payment for the services. The public offer is also accepted when the Subscriber registers on the Contractor's website. The Contractor's website is located at https://reallycool.online/. The contract number is a unique number that is issued upon registration on the Contractor's website. The provision of Services by the Contractor may be denied to public authorities, local governments, as well as state enterprises, institutions and organizations in order to comply with the Law of Ukraine "On Information Protection in Information and Telecommunication Systems".
1.4 By accepting the Agreement in accordance with the procedure specified in clause 1.3 of the Agreement, the Customer confirms that he is familiar with, agrees, fully and unconditionally accepts all the terms of the Agreement in the form in which they are set out in the text of the Agreement, including in the annexes to the Agreement, which is an integral part of it.
1.5 The Client agrees that the acceptance of the Agreement in the manner specified in clause 1.2 of the Agreement is the conclusion of the Agreement on the terms and conditions set out therein.
1.6 The Agreement cannot be withdrawn.
1.7 The Agreement does not require sealing and / or signing by the Customer and the Contractor (hereinafter referred to as the Parties) and retains its legal force.
2. The subject of the contract
2.1 The subject of this offer is a paid individual or collective (groups of 4 to 10 people) training of the Client in a foreign language via the Internet, using telecommunication tools and software (Zoom, Skype, etc.), as well as the sale of online training courses.
2.2 The Customer fully accepts the terms of the Agreement and pays for the Contractor's services in accordance with the terms of this Agreement.
3. Payment for the Services
3.1 The cost of services under the Agreement is determined in accordance with the current prices and is posted on the website https://reallycool.online/.
3.2 The cost of the service can be changed by the Contractor unilaterally.
3.3 Methods of payment for the service are indicated when making a payment.
4. Intellectual property
4.1 All text information and graphic images on the site https://reallycool.online/ are the property of the Contractor.
5. Special conditions and liability of the parties.
5.1 The Contractor is responsible for the timeliness of the services provided, when the Customer complies with the established requirements and rules posted on the website https://reallycool.online/.
5.2 The Contractor shall be exempted from liability for violation of the terms of the Agreement, if such violation is caused by force majeure, including: actions of public authorities, fire, floods, earthquakes, other natural disasters, lack of electricity, strikes, civil unrest, riots, any other circumstances, not limited to those listed, which may affect the Contractor's performance of the Agreement.
5.3 The Contractor shall not be responsible for the quality of public communication channels or services that provide the Customer with access to its services.
6. Confidentiality and protection of personal information
6.1 The Contractor undertakes not to disclose the information received from the Customer.
6.2 It is not considered a violation of the obligation to disclose information in accordance with reasonable and applicable legal requirements.
6.3 The Contractor receives information about the IP address of the visitor of the Site https://reallycool.online/. This information is not used to identify the visitor.
6.4 The Contractor is not responsible for the information provided by the Customer on the website https://reallycool.online/. in a publicly available form.
7. The procedure for consideration of claims and disputes
7.1 The Customer's claims regarding the services provided are accepted by the Contractor for consideration by e-mail within 2 (working) days from the date of the dispute to the address: info@reallycool.online.
7.2 When considering disputable situations, the Contractor has the right to request from the Customer all the documentation of interest to him regarding the event under consideration. If the Customer fails to provide the documents within 1 working day after the day of the request, the claim shall not be considered by the Contractor.
7.3 The Contractor and the Customer, taking into account the nature of the service provided, undertake to apply the pre-trial dispute settlement procedure in case of disputes and disagreements related to the provision of services. If it is impossible to settle the dispute out of court, the parties have the right to go to court. Consideration of disputes related to the provision of language school services shall be carried out in accordance with the legislation of Ukraine.
8. Other conditions
8.1 The Customer has all the rights and powers necessary for the conclusion and execution of the Agreement.
8.2 The Customer has the right at any time to unilaterally refuse the services of the Contractor. In case of unilateral refusal of the Customer from the Contractor's services, the payment made is not refundable, but can be transferred to another service.
8.3 The Contractor reserves the right to change or amend any of the terms of this Agreement at any time by publishing all changes on its website.
8.4 On all issues not regulated by this Agreement, the parties are guided by the current legislation of Ukraine.
8.5 Recognition by the court of invalidity of any provision of this Agreement and the rules does not entail the invalidity of other provisions.
